Supreme Court Does Not Lift CDC's Eviction Ban

To begin, a group of a landlords and realtor groups have requested that the CDC’s eviction moratorium be lifted. However, as of June 29th, the Supreme Court is refusing to lift the moratorium. In a 5-4 vote the U.S Supreme Court sided with renters, extending the moratorium till July 31st. Many believe that the CDC overstepped their boundaries in relation to this situation. Nevertheless, the Supreme Court agreed the decision was within the CDC’s authority.

Again, the Supreme Court ruled in favor to extend the CDC’s eviction moratorium. Judge Kavanaugh was one of the judges who recognized the overreach by the CDC. However, Kavanaugh still decided to rule in favor of the extension. In agreeing to the extension, Kavanaugh said, “In my view, clear and specific congressional authorization (via new legislation) would be necessary for the CDC to extend the moratorium past July 31,”- Law360. Furthermore, the 4 judges who voted to lift the moratorium include Justices Clarence Thomas, Samuel Alito Jr., Neil Gorsuch, and Amy Coney Barrett.

CDC's Eviction Moratorium

Beginning, back in March of 2020, the CDC’s eviction moratorium was put in place. In addition, the eviction moratorium was made to make it almost impossible for landlord to evict tenants during the pandemic. Originally, the moratorium was to be in effect from March to September of 2020. After September it was clear an extension was needed and it was extended till December of 2020. However, congress after December, extended the moratorium until June 30th of 2021. Lastly, now that the Supreme Court has reached their decision, the moratorium will be extended to July 31st of 2021.
