What is Small Claims Court?

Do you feel that you have been wronged and are entitled to money? Did your landlord with hold your security deposit even though you did not damage anything? Or perhaps, you paid for something, did not get it, and were refused a refund. If you can relate to any of the above, you may want to file a lawsuit in a small claims court. Furthermore, this article is intended to break down information related to small claims court in Illinois. “Small claims court is under the jurisdiction of the Clerks of Courts Act (705 ILCS 105) and Supreme Court Rule 282. Fees are based on the population of the county and designated by county boards.” 

Who is Allowed to Sue?

In short, any person doing business in the state of Illinois may sue in small claims court. However, you should be aware that this also applies to you. In addition, this can apply to both an individual, as well as corporations. Lastly, in the event that you are under the age of 18 years old, it is likely a judge will appoint a guardian. 

Cases Held in Small Claims Court

To begin, a variety of different cases are held in small claims court. For example, lawsuits which deal with say a breach of contract or personal injury can be handled here. Furthermore, cases involving things like the repossession of property and eviction cases can be held in small claims court. Lastly, the maximum judgement in relation to small claims court is $10,000 dollars. To clarify, your claim must not exceed this $10,000 dollar limit.
